I would like to point out two things.
I was talking about :
1) the 2-year home requirement clause attached to your J-1 visa
2) the waiver of the two year home requirement visa.
These are two totally different issues.
1) You will get a 2-year home requirement requirement on your pink J-1 sheet
, if you get sponsored by your home government or the visiting government
(USA). This clause induces you to get the WAIVER only if you would like to
stay here for one additional year!!
2) You can always in any circumstance ask for a waiver of your 2-year home
requirement. If you get it or not is a third point and we do not want to get
into it!
You still need to get a waiver if the INS tells you on your pink form that
you need to get it. Sometimes INS also makes mistakes and eventhough you
should get the 2-year home requirement rule they do not apply it to you. I
have seen this too. Then consider yourself lucky and hope they will never
discover about that!!
I repeat: a friend of mine just started the waiver process as recently as
June 2000 after being on a J-1 visa at Cornell University on a Swiss
National Foundation Fellowship for one year!! And she has already gotten it!
