You should definitely talk to the lawyer of the company that made you
an offer. He or she might suggest to go ahead and file in an
application for an H1-B already, before you obtain the waiver. By the
time you will get your application ready, you might have received
your waiver, or might have cleared your problem out. Make sure to ask
for second opinion, as many lawyers don't know anything about J1
special rules (!).
Also, what you should have is not a letter from the Kenyan embassy
but from the Dutch embassy: if you want the INS to stay out of the
idea that you are kenyan, you should not include Kenya at all in the
discussions. Why not sending again a letter to the INS but from the
Dutch embassy this time? If I were you, I would try to talk to as
many people as I could until I find the one reasonable person at the
INS that might be willing to help you. I can tell you, each person
behind their desk tells you something different!!!
